The Arkansas Cemetery Board is to consist of seven (7) members selected as follows:

The Arkansas Securities Commissioner, or his designated deputy, shall be a voting member of the board;

Six (6) members shall be appointed by the Governor for terms of four (4) years:

Four (4) of the six (6) members of the board appointed by the Governor shall be owners or operators of licensed cemeteries in this state, and these members shall be appointed from lists of five (5) names for each appointment to be made which are submitted to the Governor by the Arkansas Cemetery Association;

One (1) member shall be appointed by the Governor and shall be a citizen of the State of Arkansas, of good character, and a qualified elector, but this person shall not have any interest in a cemetery or funeral home either within or without the State of Arkansas; and

One (1) member shall be sixty (60) years of age or older, appointed from the state at large, subject to the confirmation of the Senate, and shall represent the elderly. This member shall not be actively engaged in or retired from any profession or occupation which is regulated by the board

The Governor shall appoint one (1) alternate board member for the same term and having the same qualifications as a regular board member. This member shall substitute for any regular board member when a conflict of interest disqualifies a regular board member.

Whenever a matter comes before the board involving a cemetery in which any board member has a financial interest, then the board member shall be disqualified from participating in the discussion or vote on the matter, and the alternate board member shall substitute for the disqualified board member in that instance only.

Vacancies on the board due to death, resignation, or other cause of any appointive member shall be filled by appointment of the Governor for the unexpired portion of the term in the same manner as was required for the initial appointment.
